601-A and 601 Waiver Going Above & Beyond for Our Clients

Charleston 601-A and 601 Waiver Attorney

Serving Myrtle Beach and Beyond

Navigating immigration processes like Charleston’s 601-A and 601 waivers can feel complex. The 601-A allows family members of U.S. citizens to apply for a waiver of inadmissibility before leaving the country for consular processing.

The 601 waiver addresses other grounds of inadmissibility for applicants seeking to reenter the United States. Each process requires detailed documentation and adherence to specific guidelines.

Maghzi Law Firm provides legal guidance to help you through these steps. Our team works to clarify requirements, address challenges, and assist with applications. We aim to provide a thorough understanding of the process while offering support tailored to your situation.

What Are 601-A and 601 Waivers?

The 601-A provisional waiver, also known as an unlawful presence waiver, helps certain family members of U.S. citizens or lawful permanent residents. It addresses their inadmissibility due to unlawful presence in the United States.

This waiver only applies to individuals who have accrued unlawful presence, but they do not have other disqualifying factors such as criminal convictions. Applicants must show that their U.S.-based qualifying relative would suffer extreme hardship if the waiver is denied.

The 601-A waiver allows applicants to address their inadmissibility before departing the country for consular processing, reducing the time spent separated from their families.

The 601 waiver serves a broader purpose. It addresses multiple grounds of inadmissibility, including unlawful presence, criminal activity, or fraud and misrepresentation. Unlike the 601-A, this waiver does not limit its scope to unlawful presence.

Applicants for the 601 must show that their qualifying relative would experience extreme hardship if the waiver is not approved. However, the 601 waiver process often requires more time outside the United States while awaiting a decision.

The key difference between the 601-A and 601 waivers lies in their function and timing. The 601-A waiver mainly focuses on unlawful presence and allows for pre-departure approval. The 601 waiver, however, covers a wider range of inadmissibility issues and requires applicants to remain abroad during consular processing.

The whole process can be confusing. Our team understands the subtle differences in waivers, and we can help applicants choose the form that aligns with their circumstances.
