Biden Administration Further Expands Temporary Status

Recently, President Biden and his administration expanded on and extended multiple U.S. immigration policies. First, according to the Pew Research Center, the Biden Administration has announced plans to extend Temporary Protected Status (TPS) to Afghan, Cameroonian, and Ukrainian immigrants. TPS will provide protection from deportation for up to 18 months, with the possibility of renewal.

Qualifying immigrants must have been in the U.S. since December 2020 and meet other requirements outlined by the U.S. Department of Homeland Security. The expansion is part of an effort by the Biden Administration to create a more inclusive immigration system.

In addition, Bloomberg Law reported that U.S. Citizenship and Immigration Services (USCIS) announced that certain Dreamers will be exempt from the age-out rule for green cards. The Biden Administration clarified that Dreamers who are part of the Deferred Action for Childhood Arrivals (DACA) program and have received approval for a green card before turning 21 can remain eligible under the exemption.

This rule change is expected to open the door to more permanent residency candidates, as minors whose petitions are pending beyond their 21st birthdays will now be able to receive a green card without having to start over.

Finally, last month, President Biden announced plans to extend legal status to certain immigrants with the expansion of Title 42. The Title 42 expansion affects both immigrants without documentation and those who had their visas revoked due to the Trump administration's immigration policies. This new policy provides temporary protection from deportation, work authorization, and access to healthcare. Biden's policy is part of a series of initiatives aimed at addressing the humanitarian crisis occurring at the US-Mexico border.
